Please read these conditions of use carefully before using our website. These conditions of use do not cover the supply of any products or services to you, which are set out in our Terms and conditions of supply.

1.   These terms

These conditions of use tell you the rules for using our website whether you are a guest or a registered user. By using our website, you confirm that you accept these conditions of use and that you agree to comply with them. If you do not agree to these conditions of use, you must not use our website.

Our website is directed to users residing in the United Kingdom. We do not represent that content available on or through our website is appropriate for use or available in other locations.

The definitions and rules of interpretation in this clause apply in these conditions of use (unless the context requires otherwise).

When we refer to “Chipworks”, “we”, “us” and “our” in these conditions of use it means Chipworks Data Ltd of Unit 1 Knights Court, South Chailey, Lewes BN8 4QF.

When we say “employee” we mean director, trustee, officer, staff member, volunteer or any person who carries out any activity for an organisation whether paid or not.

When we say “conditions of use”, “terms and conditions” and “terms”, it means these conditions of use.

When we use the words “write”, “writing” or “written” in these conditions of use, this includes emails.

When we say “you” and “your” in these conditions of use, it means anyone who uses our website including but not limited to
  • breeders, pet keepers and anyone whose microchip registration or transfer of keepership is received by us
  • anyone making contact with us whether via post, telephone, email, social media or through our website
  • anyone registered or wishing to register as an implanter for the purpose of recording microchip registrations
  • anyone registered or wishing to register as an authorised person or authorised organisation identified as having an interest in the microchip registration of animals
  • pet keepers and anyone identified as having an interest in the products or services of Chipworks
The headings in these conditions of use are inserted for convenience only and shall not affect its construction.

A reference to a particular law is a reference to it as it is in force for the time being taking account of any amendment, extension, or re-enactment and includes any subordinate legislation for the time being in force made under it.

3.   There are other terms that may apply to you

These conditions of use refer to the following additional terms, which also apply to your use of our website.
  • Privacy policy which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our website, you consent to such processing and you warrant that all data provided by you is accurate.
  • Acceptable use policy which sets out the permitted uses and prohibited uses of our site. When using our site, you must comply with this Acceptable Use Policy.
  • Cookie policy which sets out information about the cookies on our site.

4.   Changes to these conditions of use

We amend these conditions of use from time to time. Every time you wish to use our website, please check these terms to ensure you understand the terms that apply at that time. These terms were most recently updated in April 2020.

5.   Changes to our website

We may update our website and may change the content at any time to reflect changes to our products and services, our users' needs and our business priorities.

If the need arises, we may suspend access to the website, or close it indefinitely.

We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these conditions of use and other applicable terms and conditions, and that they comply with them.

6.   Authorised users

Breeder and pet keeper. Online access is provided for the purpose of managing the details we hold for you and your pet(s) and is on the condition that you agree to be bound by these terms and conditions or any revision thereof, and Chipworks Data Ltd reserves the right to withdraw access at any time without notice if these terms and conditions are not adhered to. You must not pass your account login details to any other person or organisation.

Implanter. Online access is provided for the purpose of registering microchips on the Chipworks database. The information you provide will be held on the Chipworks database for the life of the animal. You are responsible for the accuracy of all information that you input.

Authorised organisation. Online access is provided for the purpose of accessing data for the purpose of identification or reunification of a lost animal registered on the Chipworks database

When we say “authorised organisation”, we mean an individual or authorised employee of the following organisation types including but not limited to
  • veterinary practice
  • registered welfare/rescue organisation
  • local authority
  • police
Online access and the functionality made available to authorised users will be granted only to organisations that satisfy our eligibility criteria and at our sole discretion.

7.   Accessing the website

Access to our website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our website without notice. We will not be liable if for any reason our website is unavailable at any time or for any period. From time to time we may restrict access to some or all parts of our website to users who have registered with us.

Access to an online account by an implanter or authorised organisation is on the condition that you agree to be bound by these terms and conditions or any revision thereof, and Chipworks Data Ltd reserves the right to withdraw access at any time without notice if these terms and conditions are not adhered to.

You must keep your account details safe. If you are provided with a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential.

You must not disclose your login details to any other person or organisation and you should reset your password if you believe your account has been accessed by anyone else. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@chipworks.co.uk

We reserve the right to terminate your access to our website immediately and at any time, if you have failed to comply with any of the provisions of these conditions of use in our opinion.

These conditions of use must be brought to the attention of all your employees.

Where any employee of an authorised organisation with access to the database leaves the employment of the authorised organisation, you must ensure that access passwords are changed or access credentials are revoked.

8.   Use of animal and keeper information by authorised organisations

The information must only be used for the identification or reunification of stray or lost animals and for no other reason. Chipworks Data Ltd does not accept responsibility for any act that may arise from the misuse of this information.

The information is confidential and must not be used by or made available to any other party other than authorised organisations searching details of a pet's keeper for a legally valid reason.

Chipworks Data Ltd relies on the information provided by implanters, registrars, registered keepers or other third parties being accurate at the time it is supplied by those parties.

When using our website, you must comply with the provisions of our Acceptable use policy. You are responsible for making all arrangements necessary for you to have access to our website. You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these conditions of use, and that they comply with them.

Our website is best experienced on modern standards-compliant browsers and the latest mobile devices.

You must take appropriate steps to verify such information and obtain legal and/or other professional advice as necessary before you act or refrain from acting on the information contained in our website.

Chipworks Data Ltd makes no representations or warranties whatsoever as to the completeness and accuracy of the information contained on our website. To the extent permitted by law, Chipworks Data Ltd expressly excludes all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Chipworks Data Ltd expressly disclaims all liability and responsibility for any direct, indirect or consequential loss or damage incurred by any user arising from any reliance placed on materials posted on our website by any visitor to our website and by anyone who may be informed of any of their contents, or from the use or inability to use our website, whether directly or indirectly, resulting from inaccuracies, defects, errors, whether typographical or otherwise, omissions, out of date information or otherwise.

12.  Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:
  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our Terms and conditions of supply.
If you are a business user:
  • We exclude all implied conditions, warranties, representations or other terms that may apply to our website or any content on it.
  • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

13.  Uploading content to our website

14.  Rights you are giving us to use material you upload

When you upload or post content to our website, you grant to us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by our website and across different media.

15.  Viruses, hacking and other offences

We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our website. You should use your own virus protection software.

You agree that material downloaded or otherwise accessed through the use of our website is obtained entirely at the your own risk and that you will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data.

You must not misuse our website by knowingly introducing any spyware, computer viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. 16.  We are not responsible for websites we link to

Where our website contains links to any other websites and resources provided by third parties, these links are provided for information only should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those websites or resources and does not accept any liability or responsibility for any loss or damage that may arise from your use of them.

17.  User-generated content is not approved by us

Our website may include information and materials uploaded by other users of our website, including to bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on our website do not represent our views or values.

18.  Chipworks Chip Search service

Defra requires all compliant UK microchip database operators to use an integration tool to provide a lookup service to other compliant databases to identify where a microchip is registered as required by compulsory microchipping legislation.

When you enter a microchip number into the Chipworks Chip Search service, the number is checked against all compliant UK microchip databases. This may take several seconds in order to be completed.

If the number is valid and the microchip can be located, the name and contact details of the relevant database is returned. The lookup service does not share any personal information with any other database, just the registration status of the microchip to determine where information is held.

It is possible a microchip number may be known to one or more databases. If this is the case, you will need to contact all the listed databases in order to identify which database has the most up to date information.

19.  Notice of copyright / intellectual property rights

Chipworks Data Ltd is the owner or licensee of all intellectual property rights in our website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You are not permitted to use any registered or unregistered trade marks, service marks and/or other trade names belonging to Chipworks Data Ltd without our approval unless they are part of material you are using as permitted under 20. How you may use material on our website.

All other trade marks referred to on the website are the trade marks of their respective owners and you will require their specific authorisation should you wish to use any of the trade marks.

Any rights not expressly granted in this notice are reserved.

20.  How you may use material on our website

You may print off one copy, and may download extracts, of any page(s) from our website for your personal use and you may draw the attention of others within your organisation to content posted on our website.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any graphics, illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our website must always be acknowledged.

22.  The law

If you are a consumer user, please note that these conditions of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business user, these conditions of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

We control the website from within the United Kingdom. However, you can get access to the website from other places around the world. Although, these places may have different laws from the laws of England and Wales, by using the website you agree that the laws of England and Wales will apply to everything relating to you using our website and you agree to keep to these laws. We have the right to take you to court in the country you live in.

If a court decides that a condition is not valid, the rest of the conditions will still apply.
